Terms of use
Terms of using this site.
A portfolio, not a shop. These terms cover what you may do with what is published here — which, for most of the music, means asking first.
Version 1.0, last updated
Who runs this site
This site is published by Nick Hutson — composer, lyricist, arranger and sound designer, working as a sole trader in the United Kingdom. Anything on this page can be raised by email at nickhutson@mac.com.
Nick Hutson is a sole trader rather than a limited company, so there is no company registration number to quote and the business is not VAT registered unless an invoice says otherwise.
There is no postal address for the business. Email is the contact route for everything — commissions, permissions, corrections and anything arising from this page or the privacy notice — and it is answered by Nick himself rather than by an office.
What this site is
It is a portfolio: case studies, a credit list, recordings, video and press coverage, published so that parks, producers and directors can judge the work before commissioning any.
- Nothing is for sale here. There is no shop, no checkout and no payment of any kind.
- There are no accounts. Nothing asks you to register, log in or set a password.
- Nothing published here is an offer, a quotation or a contract. Commissions are agreed separately and in writing.
- Using the contact form obliges neither side to anything. It is a way of starting an email.
The music and audio
The line at the foot of every page is meant literally, not as decoration:
All music is used with permission and may not be reproduced without written permission from its owners.
- The recordings are published so you can listen to them in your browser. That is the use they are here for.
- Downloading, copying, re-uploading, sampling, remixing, syncing to picture, broadcasting or performing them in public is not permitted without written permission.
- Much of this music belongs to the parks, producers and production companies who commissioned it rather than to Nick. For those tracks the permission is not his alone to give — but he can tell you whose it is.
If you want to use something, ask. A lot of requests turn out to be straightforward once the right owner is in the conversation.
Text, images and code
The writing, the page design and the code of this site are Nick Hutson's, except where something is credited to somebody else. Press artwork belongs to the outlets that published it and appears here as a citation of their coverage; photographs credited to a photographer remain theirs.
Linking to any page here is welcome and needs no permission, as is quoting a short passage with a credit. Republishing pages wholesale, or presenting the work as your own, is not.
Other people's names and trademarks
Park names, ride and attraction names, event brands, show titles and client names shown on this site are the trademarks and property of their respective owners. Nothing about their appearance here transfers any right in them.
They appear for one reason: to credit work that was genuinely written, arranged or produced for those attractions. A credit is not a claim of endorsement, sponsorship, partnership or approval and none of the organisations named has reviewed or approved this site.
It is also why client names are set as type here rather than reproduced as logos. Someone else's mark on a freelance portfolio implies a relationship that a composing credit does not.
Links and embedded video
This site links out to YouTube, to press outlets and to social accounts. Those are other people's sites, run to their own terms and privacy policies and their content and availability are not Nick's responsibility.
Video is embedded from YouTube through youtube-nocookie.com. Watching a clip means using Google's service on Google's terms. Some clips start without being asked and anything left playing follows you to the pages you go to next — including this one. What all of that involves for your data is set out in the privacy notice.
Accuracy and availability
Credits are taken from Nick's own records and from material previously published about the work. Attraction credits are long-lived and details do get misremembered by everyone involved; if something here is wrong, say so and it will be corrected.
The site is published as it stands. There is no promise that it will be available without interruption, that every link will keep working, or that it is fit for any particular purpose you might have in mind for it.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Beyond that and so far as the law allows, Nick Hutson is not liable for loss or damage arising from using this site or from relying on anything published on it. If you are acting as a business, that includes loss of profit, loss of business and loss of anticipated savings.
Changes
The site and these terms can change. The version published here is the one that applies and the date at the top says when it was last revised.
Law
Nick Hutson works in the United Kingdom, which has three separate legal systems rather than one — so a clause like this has to name a particular one rather than the country. These terms and any dispute arising out of them, are governed by the law of England and Wales and the courts of England and Wales have jurisdiction.
If you are a consumer, that does not take away the protection of the law of the country you live in.
